Terms and Conditions
These Terms and Conditions govern access to and use of the Evolution Zenith website, platform interfaces, educational materials, automated trading tools, strategy functions, exchange integrations and related services.
Evolution Zenith provides technology and information for organising cryptocurrency trading workflows. The platform does not guarantee profit, does not remove trading risk and does not replace financial, legal, tax or investment advice. You remain responsible for your account, connected exchanges, strategy choices, permissions, risk limits and trading decisions.
1. Acceptance of Terms
By accessing or using Evolution Zenith, creating an account, connecting an exchange, selecting a paid plan or otherwise using any part of the service, you agree to be bound by these Terms and Conditions.
If you do not agree with these Terms, you must not access or use the platform. If you use Evolution Zenith on behalf of a company, organisation or other legal entity, you confirm that you have authority to bind that entity to these Terms.
These Terms should be read together with the Privacy Policy, Cookie Policy, Risk Disclosure, Disclaimer and Refund Policy.
2. Definitions
- Evolution Zenith
- The website, platform, interfaces, tools, content and related services made available under the Evolution Zenith name.
- User
- Any person or entity that visits, registers for, accesses or uses the website or platform.
- Connected Exchange
- A third-party cryptocurrency exchange or trading provider connected to the platform through authorised credentials or an application programming interface.
- Strategy
- A rule-based trading configuration, signal process, automation workflow or decision model available through or used with the platform.
- Content
- Text, data, interfaces, guides, illustrations, market information, educational materials and other information displayed through the service.
3. Eligibility
You may use Evolution Zenith only if you have the legal capacity to enter into a binding agreement and your use of the service is permitted in your location.
You are responsible for determining whether cryptocurrency trading, automated trading, exchange API connections and related services are lawful and available in your jurisdiction.
You must not use the platform where doing so would violate applicable law, sanctions, regulatory restrictions, exchange rules or contractual obligations.
4. Nature of the Service
Evolution Zenith provides software tools intended to help users organise market monitoring, strategy configuration, risk controls, connected exchange workflows and operational review.
Unless expressly stated otherwise, Evolution Zenith is not a cryptocurrency exchange, broker, bank, custodian, wallet provider, investment adviser, financial adviser, tax adviser or legal adviser.
Assets used in connection with the platform generally remain within accounts operated by third-party providers. Evolution Zenith does not control the internal systems, custody procedures, order matching, liquidity or withdrawal processes of those providers.
The availability of a feature does not mean that the feature is suitable for every user, asset, exchange, strategy, jurisdiction or market condition.
5. User Accounts
Certain platform functions may require registration. You agree to provide accurate, current and complete information and to keep that information reasonably updated.
You are responsible for:
- maintaining the confidentiality of account credentials;
- protecting the email account and devices linked to your account;
- enabling available authentication protections;
- reviewing active sessions and connected services;
- all activity carried out through your account, except where prohibited by law;
- notifying Evolution Zenith through the contact page if you suspect unauthorised access.
You must not share an account in a way that bypasses an access plan, account restriction, security control or authorised-user requirement.
6. Plans, Fees and Billing
Some platform functions may be available only through a paid plan or individually confirmed commercial arrangement. The applicable price, billing period, included features and material limitations should be presented before purchase or confirmed through an agreed ordering process.
Unless clearly stated otherwise, Evolution Zenith fees do not include:
- trading fees charged by a connected exchange;
- market spreads or execution slippage;
- network, blockchain or withdrawal fees;
- payment processing charges;
- taxes, duties or regulatory charges;
- third-party data, custody or infrastructure costs.
You authorise the applicable payment method to be charged according to the selected plan or confirmed order. Recurring billing will apply only where it has been clearly disclosed and authorised.
Refund eligibility is governed by the separate Refund Policy and any mandatory consumer rights that apply to the transaction.
7. Exchange Integrations and API Connections
You may be able to connect a third-party exchange account to Evolution Zenith through API credentials or another authorised integration method.
You are responsible for configuring only the permissions required for your intended use. Where supported, withdrawal or asset-transfer permissions should remain disabled.
You must comply with the connected exchange’s terms, account rules, trading restrictions and security requirements. Evolution Zenith cannot guarantee that an exchange will accept a connection, provide uninterrupted data, execute an instruction or maintain a particular API format.
You should revoke credentials that are no longer required and replace credentials that may have been exposed.
Never submit an API secret, password, private key, seed phrase or two-factor authentication code through a public website form or ordinary support message.
8. Automated Trading
Automated trading functions may monitor market conditions, apply configured rules and transmit eligible instructions to a connected exchange. Automation does not make a strategy correct, profitable or suitable.
You are solely responsible for selecting:
- the connected account and exchange provider;
- the market, asset and trading pair;
- the strategy and its parameters;
- position sizes and exposure limits;
- loss boundaries and interruption rules;
- the period during which automation remains active.
You must monitor active strategies and connected accounts. A strategy may continue to generate actions until it is paused, disabled, restricted or disconnected.
Delayed market data, rejected orders, partial fills, API interruptions, software errors, rapid price movement or changing market conditions may cause actual results to differ materially from expected results.
9. User Responsibilities
You agree to use Evolution Zenith carefully, lawfully and in accordance with these Terms.
You remain responsible for:
- evaluating whether the platform is suitable for you;
- understanding the strategies and settings you activate;
- reviewing risk disclosures before trading;
- maintaining sufficient account security;
- checking exchange balances, open orders and positions;
- meeting tax, reporting and regulatory obligations;
- obtaining professional advice when needed;
- keeping independent records of important transactions and settings.
10. Prohibited Use
You must not use the website or platform to:
- violate any applicable law, sanction or regulatory restriction;
- access another person’s account without authorisation;
- submit false, deceptive or fraudulent information;
- interfere with the security, availability or integrity of the service;
- introduce malware, malicious code or harmful automated requests;
- circumvent access controls, usage limits or payment requirements;
- reverse engineer protected platform components except where expressly permitted by law;
- scrape, copy or redistribute substantial platform content without permission;
- use the service to manipulate markets or engage in abusive trading conduct;
- misrepresent an affiliation with Evolution Zenith;
- resell account access without written authorisation.
11. Trading Risk and No Advice
Cryptocurrency trading is highly speculative and may result in rapid, substantial or complete loss of capital. Automated execution may increase the speed or frequency at which losses occur.
Information, strategies, examples, reviews, educational materials and platform outputs are provided for general informational and technological purposes.
Nothing available through Evolution Zenith constitutes:
- personalised investment or financial advice;
- a recommendation to buy, sell or hold an asset;
- a guarantee of profit or protection from loss;
- legal, accounting, regulatory or tax advice;
- an assurance that a strategy will remain effective.
You should review the separate Risk Disclosure before connecting an exchange or activating any trading function.
12. Third-Party Services
Evolution Zenith may interact with exchanges, payment processors, data providers, hosting providers and other third-party services.
Third-party services are governed by their own terms, policies and operational rules. Evolution Zenith does not control and is not responsible for:
- exchange custody or solvency;
- third-party account approval or suspension;
- provider outages or maintenance;
- changes to APIs, fees, markets or supported assets;
- order matching, liquidity or execution quality;
- third-party security incidents;
- the accuracy or continuity of external data.
Links to external websites do not imply endorsement, ownership or responsibility for their content.
13. Service Availability and Changes
Evolution Zenith may update, improve, restrict or discontinue features when reasonably necessary for security, maintenance, legal compliance, provider compatibility or service development.
Where reasonably possible and required, notice will be provided before a material change that negatively affects an active paid service. Immediate changes may be required to address security threats, legal obligations or third-party service failures.
The service may be temporarily unavailable because of maintenance, infrastructure failure, network disruption, cybersecurity events, provider outages or circumstances beyond reasonable control.
14. Intellectual Property
The Evolution Zenith name, website design, interfaces, software components, original text, graphics, documentation and other protected materials are owned by or licensed to the operator of Evolution Zenith.
Subject to these Terms, you receive a limited, personal, revocable, non-exclusive and non-transferable right to use the service for its intended purpose.
You may not reproduce, distribute, sell, sublicense, publicly display or create derivative commercial products from protected platform materials without permission, except where applicable law expressly permits it.
Feedback voluntarily submitted about the platform may be used to evaluate and improve the service. This does not transfer ownership of confidential material or personal data beyond the rights described in the Privacy Policy.
15. Security
Evolution Zenith may use technical and organisational measures intended to protect the platform. No internet-based service can guarantee absolute security.
You are responsible for maintaining the security of:
- your Evolution Zenith credentials;
- your email account;
- your connected exchange account;
- your API credentials and permissions;
- your devices, browsers and networks;
- your authentication and recovery methods.
If you believe credentials have been compromised, you should promptly change or revoke them through the relevant account provider and notify Evolution Zenith through the Contact page.
16. Suspension and Termination
You may stop using the platform at any time. Account closure, cancellation and refund rights remain subject to the selected plan, the Refund Policy and mandatory law.
Access may be restricted or suspended where reasonably necessary to:
- protect the user, platform or third parties;
- investigate suspected unauthorised access or fraud;
- address a material breach of these Terms;
- comply with law, regulation or a valid authority request;
- prevent abusive, harmful or disruptive use;
- address unpaid charges after appropriate notice;
- respond to a third-party provider restriction.
Where appropriate and legally permitted, the reason for a suspension and available next steps may be communicated to the affected user.
Before closing an account, you should disable active strategies, review open orders and revoke exchange credentials.
17. Service Disclaimers
To the maximum extent permitted by applicable law, Evolution Zenith is provided on an “as available” and “as is” basis.
No representation or warranty is made that:
- the service will always be available or error-free;
- market or third-party data will always be complete or current;
- every exchange, asset or feature will remain supported;
- a strategy will perform as expected;
- orders will be accepted or filled at a particular price;
- security incidents or unauthorised access can always be prevented;
- use of the platform will produce a financial gain.
Nothing in this section excludes a warranty or obligation that cannot lawfully be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, Evolution Zenith and its service providers will not be liable for indirect, incidental, special, exemplary or consequential loss arising from use of the service.
This may include loss arising from:
- market movement or trading decisions;
- strategy selection or configuration;
- exchange outages, insolvency or account restrictions;
- API delay, interruption or rejected instructions;
- loss of data, opportunity, revenue or expected profit;
- unauthorised access caused by compromised user credentials;
- reliance on educational or general informational content.
Where liability cannot be excluded, it will be limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or another liability that cannot legally be limited.
19. Indemnification
To the extent permitted by applicable law, a business user or user acting outside a consumer capacity agrees to indemnify Evolution Zenith against reasonable third-party claims arising directly from:
- unlawful use of the platform;
- a material breach of these Terms;
- infringement of another person’s rights;
- fraudulent, abusive or unauthorised activity;
- content or data submitted without the required rights.
This section does not apply where prohibited by mandatory consumer law and does not cover loss caused by Evolution Zenith’s own unlawful conduct.
20. Mandatory Consumer Rights
If you use Evolution Zenith as a consumer, you may have mandatory rights that vary by jurisdiction. These rights may include requirements concerning pre-contract information, digital service conformity, cancellation, remedies, fair contract terms and transparent recurring payments.
Nothing in these Terms is intended to waive or restrict a consumer right that cannot legally be waived.
If a provision conflicts with mandatory consumer law, the mandatory rule will apply to the extent of the conflict, while the remaining provisions continue in effect.
21. Applicable Law and Disputes
These Terms are subject to the laws that legally apply to the operator of Evolution Zenith, the relevant transaction and the user, including any mandatory consumer protection rules that cannot be excluded by agreement.
Before beginning formal proceedings, you are encouraged to submit a clear written description of the dispute through the Contact page so that the matter can be reviewed.
The competent court, tribunal or dispute-resolution body will be determined according to applicable law. Consumers retain access to any local forum or remedy that cannot lawfully be restricted.
22. Changes to These Terms
These Terms may be updated to reflect changes in the service, applicable law, security requirements, payment processes or third-party integrations.
The updated version will display a revised “Last updated” date. Where required by law or reasonably appropriate, material changes will be communicated through the website, platform or another available contact channel.
Continued use after the effective date of updated Terms may constitute acceptance where legally permitted. If you do not accept a material change, you should stop using the affected service and review available cancellation rights.
23. General Provisions
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
A failure to enforce a provision immediately does not automatically waive the right to enforce it later.
You may not transfer your account or contractual rights without permission where such consent is lawfully required. Evolution Zenith may transfer contractual rights as part of a legitimate business restructuring, provided that mandatory user and consumer rights are preserved.
These Terms and the policies incorporated by reference form the agreement concerning use of the service, unless a separate written commercial agreement expressly applies.
