Refund Policy
This Refund Policy explains how cancellations, renewal charges, billing errors, service-access issues and refund requests are handled for paid Evolution Zenith plans and digital platform services.
Cancelling a subscription stops future renewal charges but does not automatically reverse a charge already processed. Refund requests are assessed according to the purchase terms, service usage, billing circumstances, technical evidence and mandatory consumer law.
1. Scope of This Policy
This Refund Policy applies to payments made directly for Evolution Zenith subscriptions, account plans, digital platform access and other paid services expressly governed by this Policy.
It does not govern payments made directly to an exchange, payment processor, wallet provider, market-data provider or another independent third party.
A separate written commercial agreement may contain specific billing, cancellation or refund terms. Where that agreement applies, its provisions control to the extent of any inconsistency with this Policy.
This Policy should be read together with the Terms and Conditions, Risk Disclosure and the pricing information presented before purchase.
2. Key Definitions
- Cancellation
- A request to stop a subscription from renewing after the current paid period.
- Refund
- A full or partial reversal of an eligible payment already processed for an Evolution Zenith service.
- Billing period
- The period of platform access covered by a subscription or one-time payment.
- Renewal
- A new billing period created through an authorised recurring-payment arrangement.
- Mandatory right
- A cancellation, withdrawal, remedy or refund right that cannot legally be excluded by contract.
3. Information Presented Before Purchase
Before completing a paid purchase, users should be shown the material terms associated with the selected service.
These terms may include:
- the plan or service being purchased;
- the price and applicable currency;
- the billing period;
- whether the payment is one-time or recurring;
- the included platform functions;
- material usage or account limitations;
- available cancellation methods;
- applicable taxes or payment charges;
- any special refund or promotional terms.
Users should review these terms before authorising the payment. Completing the purchase indicates acceptance of the disclosed commercial terms, subject to rights that cannot legally be waived.
4. Cancellation Is Different from a Refund
A subscription cancellation prevents future renewal charges after the cancellation becomes effective.
Unless the purchase terms or applicable law provide otherwise, cancellation does not automatically:
- reverse a payment already processed;
- create a refund for a partially used billing period;
- compensate for unused platform access;
- cancel third-party exchange or payment-provider fees;
- reverse completed trading activity.
Following cancellation, access may continue until the end of the already paid billing period unless immediate termination is requested, required for security or stated otherwise in the applicable plan.
To avoid another renewal charge, submit the cancellation before the next billing event and confirm that the subscription status has changed.
5. Recurring Subscriptions and Automatic Renewals
A recurring subscription renews according to the period and price presented during the ordering process unless it is cancelled before the next renewal.
The purchase process should clearly identify:
- that the plan renews automatically;
- the renewal frequency;
- the amount or method used to determine the renewal price;
- how the user can cancel;
- when cancellation becomes effective.
A user is responsible for reviewing account and billing status before the renewal date. Evolution Zenith should provide a reasonably accessible cancellation method.
If the renewal price or billing structure changes materially, the change should be communicated where required before the new charge applies.
6. Mandatory Consumer Withdrawal Rights
Consumers in certain jurisdictions may have a statutory period during which they can withdraw from a distance contract for a digital service.
Where such a right applies, it remains available according to the conditions and exceptions established by applicable law.
A withdrawal right may be affected where:
- the user expressly requested immediate service activation;
- digital access or performance began during the withdrawal period;
- the user acknowledged a legally valid consequence of immediate performance;
- a proportionate payment is permitted for service already supplied;
- a statutory exception applies to the relevant digital content or service.
Nothing in this Policy removes a withdrawal, cancellation or refund right that cannot lawfully be excluded.
7. Circumstances That May Qualify for a Refund
A full or partial refund may be considered where supported by the available records and applicable terms.
Billing and payment problems
- A confirmed duplicate charge
- An incorrect amount charged by Evolution Zenith
- A payment processed after a valid cancellation
- An unauthorised payment supported by appropriate evidence
- A payment for a service that was not activated
Material service problems
- Paid access was not delivered
- A purchased core feature was materially unavailable
- A confirmed Evolution Zenith error prevented intended access
- A mandatory digital-service remedy applies
- A statutory withdrawal right was exercised validly
Eligibility does not mean that every request will result in a full refund. The appropriate remedy may be a correction, restored access, service extension, account credit, partial refund or full refund.
8. Circumstances Normally Not Eligible for a Refund
User decisions and account use
- Changing your mind after substantial platform use
- Forgetting to cancel before a disclosed renewal
- Not using available access during the billing period
- Selecting an unsuitable strategy or market
- Incorrectly configuring an account or integration
- Failing to meet a third-party exchange requirement
External events and trading outcomes
- Market losses or missed profit
- Exchange downtime or account suspension
- Slippage, fees or rejected exchange orders
- API interruption controlled by a third party
- Loss caused by compromised user credentials
- A change in cryptocurrency price or liquidity
An exclusion will not apply where mandatory law requires a refund, repair, price reduction, cancellation or other remedy.
9. No Refunds for Trading Losses or Performance
Evolution Zenith does not refund subscription or platform fees because a strategy, asset, market or connected account generated a loss, drawdown, liquidation or lower-than-expected return.
Refunds are not provided for:
- losses caused by market movement;
- unprofitable strategy performance;
- a missed trading opportunity;
- difference between simulated and live results;
- slippage, spread or exchange fees;
- liquidation of a leveraged position;
- an incorrect user-selected risk setting;
- failure to pause an active strategy;
- reliance on educational or general market information.
Platform charges relate to access to the applicable software service and do not purchase or guarantee a particular investment result.
10. Technical Problems and Service Availability
A temporary technical problem does not automatically create a right to a refund.
When reviewing a technical-service request, relevant factors may include:
- the affected paid feature;
- the duration and materiality of the issue;
- whether other service functions remained available;
- whether the issue originated with Evolution Zenith;
- whether the problem was caused by a connected exchange;
- whether reasonable troubleshooting steps were available;
- whether access was restored or the issue corrected;
- the requirements of applicable digital-service law.
Depending on the circumstances, an appropriate response may include restored access, correction of the feature, an account credit, an extension of service, a partial refund or a full refund.
11. Third-Party Fees and Independent Providers
Evolution Zenith cannot normally refund amounts charged directly by an independent provider.
These charges may include:
- exchange trading fees;
- market spread and slippage;
- derivative funding payments;
- network or blockchain fees;
- withdrawal or custody charges;
- currency-conversion charges;
- payment-provider or bank fees;
- taxes collected and remitted independently;
- third-party data or software subscriptions.
A request concerning a third-party charge should be submitted to the provider that processed or retained the relevant amount.
12. Trials, Discounts, Credits and Promotions
A free trial, promotional plan, discount, voucher or account credit may be subject to additional terms presented when the offer is made.
Unless otherwise required by law:
- unused promotional value may not be redeemable for cash;
- account credits may be non-transferable;
- expired promotional periods may not be restored;
- a discount may not apply to a later renewal;
- a free trial may convert to a paid plan only under disclosed terms;
- refunds may reflect the amount actually paid rather than the standard price.
Promotional terms do not remove mandatory cancellation or consumer-protection rights.
13. Currency, Exchange Rates and Crypto Payments
A payment may be displayed or processed in a currency different from the currency used by the user’s bank, card provider or wallet.
A refund will normally be based on the amount and currency recorded for the original Evolution Zenith transaction, subject to the capabilities of the payment provider.
Evolution Zenith is not responsible for differences caused by:
- foreign-exchange movements;
- bank conversion rates;
- payment-provider conversion charges;
- changes in cryptocurrency value;
- blockchain transaction fees;
- intermediary bank charges.
Where a refund of a cryptocurrency payment is supported, the refund method and amount may be determined by the original transaction terms, payment processor and applicable legal requirements.
14. How to Submit a Refund Request
A refund or billing request should be submitted through the Evolution Zenith Contact page.
Include:
- the name associated with the account;
- the account email address;
- the relevant plan or service;
- the transaction date;
- the transaction or invoice reference where available;
- the reason for the request;
- the requested outcome;
- non-sensitive evidence supporting the request.
Do not submit full card details, passwords, authentication codes, API secrets, private keys or wallet recovery phrases.
Provide the plan, transaction date and available billing reference.
Describe the billing, access or technical problem clearly.
Attach only relevant non-sensitive records or screenshots.
State whether you seek correction, cancellation, credit or refund.
15. Review of Refund Requests
A request may be reviewed against account, payment, access, cancellation and technical records.
Evolution Zenith may request additional information reasonably needed to:
- identify the transaction;
- verify the requester;
- confirm whether a duplicate or incorrect charge occurred;
- determine whether the service was activated or used;
- separate an Evolution Zenith issue from a third-party issue;
- evaluate an unauthorised-payment allegation;
- apply mandatory consumer rights.
Requests should be assessed within a reasonable period. Complex requests, payment-provider investigations, identity verification or third-party evidence may require additional review.
The decision should identify the approved remedy or the principal reason why the request does not qualify.
16. General Eligibility Matrix
| Situation | Typical status | Possible response | Important condition |
|---|---|---|---|
| Confirmed duplicate charge | Potentially eligible | Correction or refund | The duplicate payment must be verified |
| Payment after valid cancellation | Review required | Refund or billing correction | Cancellation timing and status must be confirmed |
| Paid service never activated | Potentially eligible | Activation, credit or refund | The issue must relate to Evolution Zenith delivery |
| Material service defect | Review required | Repair, extension, reduction or refund | Depends on severity, correction and applicable law |
| Valid statutory withdrawal | Legal right | Remedy required by applicable law | Conditions and digital-service exceptions may apply |
| Unused subscription period | Normally excluded | Cancellation of future renewal | Mandatory rights may still apply |
| Forgotten renewal | Case review | Cancellation or discretionary remedy | Depends on disclosure, usage and applicable law |
| Trading loss | Not refundable | No platform-fee refund based on performance | Trading outcomes are not guaranteed |
| Exchange outage or API failure | Provider review | Technical review, not automatic refund | Responsibility depends on the source of the failure |
| Third-party trading fee | External charge | Contact the charging provider | Evolution Zenith did not process the fee |
17. Refund Method and Processing
An approved refund will normally be returned through the original payment method where technically and legally possible.
An alternative method may be required where:
- the original payment method is no longer available;
- the payment provider does not support the original route;
- a legal or fraud-prevention restriction applies;
- the parties agree to another lawful method;
- an account credit is accepted as the remedy.
After Evolution Zenith authorises a refund, the time required for it to appear may depend on the card issuer, bank, payment processor, blockchain or other provider.
Evolution Zenith cannot guarantee a third party’s posting or settlement time.
18. Payment Disputes and Chargebacks
Users are encouraged to contact Evolution Zenith before opening a payment dispute so that a billing error, cancellation record or access problem can be reviewed.
This does not prevent a user from exercising a lawful right to contact a bank, card issuer, payment provider or consumer authority.
When a chargeback or payment dispute is opened, Evolution Zenith may provide relevant transaction, consent, access, cancellation and communication records to the payment provider where legally permitted.
Account access may be restricted while a disputed payment is investigated, particularly where the underlying paid service has not been settled.
19. Fraudulent or Abusive Refund Requests
Evolution Zenith may reject or investigate a request that appears fraudulent, misleading or abusive.
This may include:
- providing false transaction information;
- claiming non-receipt after substantial verified use;
- repeatedly purchasing and refunding the same service;
- using multiple accounts to bypass plan restrictions;
- submitting altered payment evidence;
- opening a knowingly false unauthorised-payment claim;
- attempting to retain access after receiving a refund.
Appropriate account restrictions may be applied where permitted by the Terms and applicable law.
20. Business, Professional and Custom Accounts
Business, professional, institutional or custom services may be governed by a separate order, invoice or written agreement.
That agreement may specify:
- a minimum contract period;
- setup or implementation fees;
- usage-based charges;
- notice periods;
- non-refundable reserved capacity;
- custom development charges;
- service credits;
- termination payments.
Mandatory consumer rights may not apply to purchases made solely for business or professional purposes.
21. Mandatory Legal and Consumer Rights
Nothing in this Refund Policy excludes or restricts a cancellation, withdrawal, refund, repair, replacement, price-reduction or digital-service right that cannot lawfully be excluded.
If this Policy provides less protection than a mandatory rule applicable to the transaction, the mandatory rule applies to the extent of the conflict.
Consumer rights may vary according to:
- the user’s location;
- the operator’s legal location;
- the type of digital service;
- whether performance began immediately;
- whether the user acts as a consumer or business;
- how the payment and contract were concluded.
A user may submit information about an applicable statutory right through the Contact page.
22. Changes to This Refund Policy
This Policy may be updated to reflect changes in plans, billing systems, payment providers, platform functions or applicable legal requirements.
The revised version will display an updated date. Changes should not retroactively remove a refund or consumer right that already applies to a completed purchase.
Material changes affecting recurring plans may be communicated through the website, account interface, billing process or another available contact channel where required.
